These Terms of Service govern your use of games published under the “ASP Games” brand.
The ASP Games brand is operated by Oleksandr Spiian (Oleksandr Borysovych Spiian), an individual entrepreneur (sole proprietor) registered in Ukraine (“ASP Games”, “we”, “us”). By downloading, installing, or playing any of our games (the “Games”) from Google Play or the Apple App Store, you agree to these Terms. If you do not agree, please do not use the Games.
01License to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Games on devices you own or control, for your own personal, non-commercial entertainment, subject to these Terms, the Google Play Terms of Service, and — on iOS — the Apple Licensed Application End User License Agreement (the standard Apple EULA). Where these Terms conflict with the Apple EULA on iOS, the Apple EULA prevails for that platform.
02Acceptable use
You agree not to:
- Reverse engineer, decompile, or modify the Games, except where permitted by law.
- Use cheats, bots, exploits, or unauthorized third-party software.
- Disrupt or interfere with the Games, our servers, or other players.
- Use the Games for any unlawful purpose or in violation of any applicable law.
- Resell, redistribute, or commercially exploit the Games without our permission.
03Purchases & virtual items
Some Games offer optional in-app purchases, including virtual items and currency. All purchases are processed by Google Play (Android) or the Apple App Store (iOS) and are subject to their terms.
- Virtual items have no real-world monetary value and cannot be exchanged for cash.
- Virtual items are licensed, not sold, and may be modified or discontinued.
- Refunds are handled in accordance with the Google Play or Apple App Store refund policy and applicable consumer law.
04Advertising
Our Games are supported by advertising provided through third-party ad networks. Ads may include rewarded, interstitial, and banner formats. Your interaction with ads and any data collected by ad networks are subject to our Privacy Policy and the networks’ own policies.
05Intellectual property
All content in the Games — including code, graphics, audio, characters, and trademarks — is owned by ASP Games or its licensors and is protected by intellectual property laws. The license in Section 1 does not transfer any ownership rights to you.
06Accounts & cloud saves
Some Games allow you to sign in or use cloud saves to store progress. You are responsible for keeping your sign-in credentials secure. You may request deletion of your account data at any time via our Data & Account Deletion page.
07Disclaimers
The Games are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Games will be uninterrupted, error-free, or secure.
08Limitation of liability
To the maximum extent permitted by law, ASP Games shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Games. Nothing in these Terms limits liability that cannot be excluded under applicable law, including your mandatory statutory consumer rights.
09Termination
We may suspend or terminate your access to the Games if you violate these Terms. You may stop using the Games at any time by uninstalling them. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
10Apple App Store — additional terms
The following applies when you obtain a Game from the Apple App Store:
- These Terms are concluded between you and ASP Games only, not with Apple. Apple is not responsible for the Games or their content.
- Apple has no obligation to furnish any maintenance or support services for the Games.
- In the event the Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
- Apple is not responsible for addressing any claims relating to the Game, including product-liability, legal/regulatory, or intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
11Governing law
These Terms are governed by the laws of Ukraine, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your country of residence apply.
12Changes to these Terms
We may update these Terms from time to time. The “Last updated” date reflects the latest version. Continued use of the Games after changes take effect constitutes acceptance of the revised Terms.
